Good post, but this part is wrong. Federal Wage and Hour DOES NOT regulate break times. They only are concerned that they are paid accordingly.

State laws may differ, but it isnt a Wage and Hour thing.

Federal law does not require lunch or coffee breaks. However, when employers do offer short breaks (usually lasting about 5 to 20 minutes), federal law considers the breaks work-time that must be paid. Unauthorized extensions of authorized work breaks need not be counted as hours worked when the employer has expressly and unambiguously communicated to the employee that the authorized break may only last for a specific length of time, that any extension of the break is contrary to the employer's rules, and any extension of the break will be punished.

Bona fide meal periods (typically lasting at least 30 minutes), serve a different purpose than coffee or snack breaks and, thus, are not work time and are not compensable.

Got one coming myself... it'll be the 4th in as many years. This guy's a complete moron, though, and incompetent beyond belief... we've been so busy we've tolerated it and spent loads of time managing his workload so he can't cause us to lose more clients (he cost us out biggest two in his first month last year). I'm looking forward to being rid of him, but he's the unstable type, so it's going to be awkward no matter what I say. I don't know if I've ever met a dumber human being or a more incompetent employee.

Fortunately I've got a laundry list of things to give him/anyone should it be necessary. But, not being a confrontational type, I dread his wanting a fight.

Well, Robert, it's Friday night, and your firing is over. Glad to hear that you are still sans-gunshot wounds. Sounds like he wasn't so disgruntled after all.

Since he was 45 minutes late on his 2nd day on the job.. it was very easy. He rolled in not expecting to see his boss man, but one of the other technicians. He pulled up and started talking about how bad his morning had been.. blah blah blah... I asked him if he had a phone, "uhhh, yeh".. I then asked if he didn't still have all of our phone numbers.. "uhhh, yeh" Then it was simply, you should have called.. I'll pay you for your time yesterday and your time and mileage today...

Anyone looking for a job in Knoxville?

I actually had a guy say "No way, You can't fire me".

I told him he was welcome to continue working, I just wasn't going to pay him anymore. He said "Oh" and left.
